Welcome to Mama Sales. By using our online wholesale order taking platform, you agree to be bound by the following Terms of Service ("TOS"), including any additional terms and conditions and policies referenced herein or available by hyperlink. These TOS apply to all users of our app, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Definitions

·   "User": Anyone who accesses and uses our platform.

·   "Services": The B2B order-taking and delivery services provided by Mama Sales.

·   "Account": The user account created for accessing our services.

·   "Order": The request placed by a user for products through our platform.

·   "Platform": The Mama Sales website and any associated applications.

User Responsibilities and Account Guidelines

·   Account Registration: Users must provide accurate and complete information during registration. Users are responsible for maintaining the confidentiality of their account credentials.

·   Account Use: Users must not use their account for any illegal or unauthorized purpose. Any breach of security or unauthorized use of an account must be reported to us immediately.

·   Conduct: Users must not engage in conduct that could harm the integrity or functionality of our platform. This includes, but is not limited to, uploading malicious software, attempting to access unauthorized areas, or harassing other users.

Description of Services

Mama Sales offers a B2B platform where retailers can book and order products, which are then sourced from wholesalers and delivered to the retailers. Our services include:

·   Sourcing products from wholesalers

·   Handling logistics and delivery to retailers

·   Customer support and assistance

Products

Our online wholesale store app sells beverages, snacks, biscuits, candies, chocolates, cosmetic products, tobacco, and cigarettes. Please note that tobacco and cigarettes are only available for sale to customers who are 21 years old and have a store. We do not sell these products to individuals or minors.

Health Disclaimer

Please note that consuming tobacco and cigarettes is harmful to your health and can cause death. As such, we ask that you sell these products only to customers who are above 18 years old and have a store.

Order Processing and Acceptance

·   Order Placement: Users can place orders through our platform by selecting products and providing necessary details.

·   Order Confirmation: All orders are subject to acceptance by Mama Sales. We reserve the right to refuse or cancel any order for any reason.

·   Order Changes: Users can request changes to orders before they are processed. Once an order is processed, changes may not be possible.

·   Order Delivery: We strive to deliver orders within the specified time frame. However, delays may occur due to unforeseen circumstances. Users will be notified of any significant delays.

Delivery

Please check your order at the time of delivery only. We will not be responsible for any missing or damaged products if you do not check them at the time of delivery.

Intellectual Property Rights

·   Ownership: Mama Sales owns all intellectual property rights to the content, design, and functionality of the platform. Users are granted a limited license to access and use the platform for its intended purpose.

·   Restrictions: Users must not reproduce, distribute, modify, or create derivative works based on any content from the platform without our express permission.

Limitation of Liability

·   Service Disclaimer: While we strive to provide accurate and reliable services, Mama Sales does not guarantee the completeness, accuracy, or reliability of any information on our platform.

·   Liability Limit: Mama Sales will not be liable for any damages arising from the use or inability to use our services, including direct, indirect, incidental, or consequential damages.

·   Indemnity: Users agree to indemnify and hold Mama Sales harmless from any claims, losses, or damages arising from their use of the platform or violation of these terms and conditions.

Governing Law and Dispute Resolution

·   Governing Law: These TOS and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Uttar Pradesh, India, without giving effect to its conflict of law provisions.

·   Dispute Resolution: Any disputes arising from the use of our platform or related to these terms and conditions will be resolved through negotiation and, if necessary, binding arbitration or litigation in the appropriate courts of Uttar Pradesh, India.

Changes to Terms and Conditions

Mama Sales reserves the right to modify these TOS at any time, so please review them frequently. Changes and clarifications will take effect immediately upon their posting on the app. If we make material changes to these TOS, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
